We’ve updated our Terms of Purchase with the release of our new membership levels and benefits. With this revision comes a new set clear set of guidelines for our players. Below are the Terms and Conditions of Sale that contain those guidelines.

General Terms and Conditions

Order Confirmations

Please review your order carefully following your purchase to be sure that it is correct. If you do not receive a confirmation page at the end of the process with an order number or a confirmation email, it’s possible that there was an issue. In this case, please call the league office at 617-440-PUCK to verify that your order was not successfully placed.

Refund Policy for leagues, season passes, games, skills, and events

Unless otherwise noted, all leagues, season passes, games, skills, and events, are non-refundable.

SEASON PASSES

No Commitment Hockey Season Passes are refundable up to 2 weeks prior to the first game/session of the season and non-refundable thereafter. Individual game cancellations follow the No Commitment Hockey game terms below

NO COMMITMENT HOCKEY EVENTS

No Commitment Hockey games and skills sessions are non-refundable but callout benefits are available when you cancel in advance. Cancel more than 6 hours before your game/session time. receive a promotional gift certificate in the amount of the value of a canceled game/session. Promotional gift certificates are valid toward the cost of another game/session within 30 days of your originally scheduled event. Cancellations within 6 hours of event time result in forfeiture of value. Other membership benefits may apply. No Commitment games canceled by StinkySocks Hockey for any reason result in the issuance of a regular gift certificate code that does not expire.

BYOT and DRAFT LEAGUES, TOURNAMENTS, and OTHER SERVICES/EVENTS

BYOT Leagues, Draft Leagues, Tournaments, Events, and other services, including deposits made, are non-refundable.

Returns and Exchanges of Durable Goods

All durable goods that are in their original condition may be returned for a full refund within 30 days or purchase, with the exception of clearance items (denoted with a price that ends in .01). Jerseys that have been taken out of the package can still be returned, provided that they have not been worn in a game or laundered.

HOW TO GET A RETURN STARTED

To return an item, contact the StinkySocks Hockey office at 617-440-PUCK to obtain a return authorization number and then return your items via a traceable carrier. All returns should be addressed to: StinkySocks Hockey 369 Congress St, Floor 7B Boston, MA 02110

WHERE’S MY MONEY?

Once your return is received it will be processed within 2 business days. Once processed, your refund will be issued to the original form of payment and you will receive an automated notice for refund via email. Funds leave our bank immediately but please allow 2-5 business days, depending on your bank, for the refund to appear on your credit card or bank statement. Refunds issued back to a StinkySocks Hockey gift code are available for use immediately following confirmation of your refund.

RETURN SHIPPING

We can provide a UPS return label upon request and deduct the actual shipping cost from your refund. We also welcome you to stop by our office to make your return or exchange.

Returned Payments and Overdue Balances

Returned Payments

Any returned payments, including returned checks or credit card disputes, are subject to a $40 handling fee, and will result in an overdue balance on your account.

Overdue Balances

Any overdue balance will be subject to a monthly fee of 2%. Players who have an overdue balance are ineligible to participate in any StinkySocks Hockey game or event until the account is brought current and are not eligible for any compensation for games that are missed as a result of ineligibility. In the event that StinkySocks Hockey must resort to third party collections, or legal action, to collect on your account, you agree to be responsible for any necessary costs incurred in the process.

Payment Plans

AGREEMENT TO PAY

If you elect a payment plan, you agree to make all payments in full and authorize StinkySocks Hockey to charge your credit card on file in accordance with the payment plan schedule. If the first date of the Payment Plan Schedule has passed then the first installment will be charged immediately and is in addition to any deposit required. Please note that payments may be charged on the scheduled payment date or at any time thereafter. Payment plans are a structured agreement to pay over time and are not an offer of credit.

TRANSACTION FEES

Transactional fees apply (generally $5/payment), as indicated in the original terms, and are included in the payment installments.

DECLINED CHARGES AND COLLECTIONS

You acknowledge responsibility for any outstanding balance that exists as a result of declined charge(s). Any payments that are declined by your bank may be reattempted. Declined payments that are not brought current within 7 days are subject to a $20 internal collections fee. Thereafter, any overdue balance will be subject to a monthly fee of 2%. Players who have an overdue balance are ineligible to participate in any StinkySocks Hockey game or event until the account is brought current and are not eligible for any compensation for games that are missed as a result of ineligibility. In the event that StinkySocks Hockey must resort to third party collections, or legal action, to collect on your account, you agree to be responsible for any necessary costs incurred in the process.

Compliance with Laws, Rules, Policies, and Regulations

Purchasers agree to observe and obey all the Laws, Rules, Policies, and Regulations, inform all participants and spectators you bring with you of the Laws and Regulations, and obtain the consent of all participants on whose behalf you book, to observe and obey the Laws, Rules, Policies, and Regulations. Laws, Rules, Policies, and Regulations, means all requirements of all laws, orders, ordinances and regulations of the federal, provincial, state, county, and municipal authorities, the terms and conditions of any purchase, policies of the StinkySocks Hockey, polices of any facilities at which a game or event takes place, rules of the game, league, or event(s), and directives and orders from StinkySocks Hockey, our employees, our subcontractors, and the employees of any facility at which a game or event takes place. Purchasers and participants agree to be bound by the final decision of StinkySocks Hockey in the interpretation or any rules and policies.

Authorization for Use of Image, Voice, Performance, or Likeness

Participants authorize StinkySocks Hockey and its employees, agents, representatives, subcontractors, and personnel who are acting on behalf of StinkySocks Hockey to create and/or obtain and use their photograph, voice or quotes/excerpts of written or verbally expressed words, video and/or audio recording, or other likeness. Authorization is given by the participant without compensation.

Authorization for Communication

By providing any phone number, you authorize StinkySocks Hockey to contact you via phone.

TEXT MESSAGING

By providing a mobile phone number, you authorize StinkySocks Hockey to contact you via text messaging. Our mobile text messages are intended for subscribers over the age of 18 and are delivered via a USA-based 10 digit phone number in area code 617. You may receive up to 8 message(s) per month. Message & Data Rates May Apply. This service is available for phones with text messaging capabilities. For help or to request that text messages not be sent to your mobile number, please call the league office at 617-440-7825 or email office@stinkysocks.net. Email By providing any email address, you authorize StinkySocks Hockey to contact you via email. Email is the primary source of transaction communication that pertains to your league, game, or other event. These include order confirmations, payment confirmations, league welcomes, team assignments, renewals, cancelations, changes, customer service requests, etc. Occasionally, personalized emails may be sent to you based on your playing history to alert you to new options that fit your profile. To opt out of such email, please contact the league office. Mass marketing emails can be opted into at the time of purchase of any time thereafter. To unsubscribe for such email, simply click “unsubscribe” at the bottom of any such email or contact the league office.

Limitation of Liability

(a) IN THE EVENT YOU OR ANY OF THE PARTICIPANTS ON WHOSE BEHALF YOU BOOK ARE INJURED, BECOME ILL, OR DIE, OR YOUR PROPERTY IS LOST OR DAMAGED, STINKYSOCKS HOCKEY WILL NOT BE LIABLE TO YOU OR YOUR PARTICIPANTS FOR ANY DAMAGES UNLESS THE OCCURRENCE WAS DUE TO OUR NEGLIGENCE OR WILLFUL FAULT. WE DISCLAIM LIABILITY TO YOU OR YOUR PARTICIPANTS UNDER ANY CIRCUMSTANCES FOR INFLICTION OF EMOTIONAL DISTRESS, MENTAL SUFFERING OR PSYCHOLOGICAL INJURY WHICH WAS NOT: (i) THE RESULT OF PHYSICAL INJURY TO YOU OR YOUR PARTICIPANTS CAUSED BY THE NEGLIGENCE OR FAULT OF AN EMPLOYEE; (ii) THE RESULT OF YOU HAVING BEEN AT ACTUAL RISK OF PHYSICAL INJURY, AND SUCH RISK WAS CAUSED BY THE NEGLIGENCE OR FAULT OF AN EMPLOYEE; OR (iii) INTENTIONALLY INFLICTED BY AN EMPLOYEE. IN NO EVENT WILL WE BE LIABLE TO YOU FOR CONSEQUENTIAL, INCIDENTAL, EXEMPLARY OR PUNITIVE DAMAGES. (b) WE ASSUME NO LIABILITY IN RESPECT OF THE ACTS OR OMISSIONS OF ANY THIRD PARTY. YOU AND YOUR PARTICIPANTS, ON BEHALF OF YOURSELF AND ANY AND ALL OF YOUR HEIRS, SUCCESSORS AND ASSIGNS, COVENANT NOT TO SUE OR TO INSTITUTE OR CAUSE TO BE INSTITUTED ANY KINDS OF CLAIM OR ACTION IN ANY FOREIGN, FEDERAL, STATE OR LOCAL AGENCY OR COURT AGAINST US ARISING OUT OF, IN THE COURSE OF, FROM OR ATTRIBUTABLE TO ANY GAME OR EVENT.

WHEN YOU BOOK FOR OTHERS

Individuals who book on behalf of others are required to provide StinkySocks Hockey with a list of participants so that we can verify eligibility and transfer the purchase into their account(s). When booking on behalf of someone else, you agree to inform your guest(s) that they are not permitted to participate until the read and sign a waiver of liability. Individuals may not participate in any StinkySocks Hockey game or event under any circumstance without a having read and signed a waiver of liability beforehand.

Cancelations by StinkySocks Hockey

StinkySocks Hockey reserves the right to cancel any league, game, or event, for any reason that StinkySocks Hockey, in its sole discretion, deems necessary. In the event of inclement weather, StinkySocks Hockey yields to the facility where the game is to be played (or the event held) to determine in their best judgment whether or not they should remain open. When the facility is to remain open, all games will continue as scheduled. If they are to close then the game will be canceled or rescheduled. Facilities may also deem it necessary to cancel a game if they are unable to provide a safe or otherwise usable playing surface. In the event of a cancelation, we will make every attempt to contact players, or the team captain in the case of a team-based league, such as BYOT. To facilitate that, it is important to have current contact information on your original order. Players are notified by text message, phone, and/or email. If you would like to be notified by text message (usually the quickest way to get out the message), please be sure that the primary phone number on your order is a number capable of receiving text messages.

Indemnification

Purchaser agrees to indemnify and hold StinkySocks Hockey, our employees, our subcontractors, owners and agents harmless for (a) any damages, liabilities, losses, penalties, fines, charges or other expense incurred by or imposed upon us, our employees, our subcontractors, owners or agents as a result of any act, omission or violation of Laws or Regulations by you or any participant for whom you are responsible; and (b) any liability, cost or expense (including all legal expenses) incurred by or imposed upon us, our employees, our subcontractors, owners or agents associated with the defense or settlement of any claim, directly or indirectly related to personal injury, death or property damage relating to any act of you, or any participants on whose behalf you book.

Force Majeure

StinkySocks Hockey shall not be responsible for any loss, damage, delay or failure of performance arising or resulting from: acts of God; acts of war; acts of public enemies, strike or omission; restriction by foreign government, or anything whatsoever beyond our control.

Additional Product-Specific Terms and Conditions

RIGHT AND AGREEMENT TO PARTICIPATE

By purchasing a game or skills clinic through No Commitment Hockey (“NCH”), you are purchasing the non-transferable right to participate in that event, provided that you meet the qualifications for eligibility. You agree to be bound by these terms and conditions and the rules and policies of the league. Since your attendance at a No Commitment Hockey games directly affects the experience of other players, you agree to give notice to the league in accordance with our attendance policy in the case that you cannot attend the game that you have purchased.

BEST EFFORT SERVICE PROMISES

We want every game to be perfect and our promise to you is that we’ll make every effort for that to happen. However, there are many variables involved in producing a game, some of which may be out of our direct control at times. As such, our No Commitment Hockey games are offered as a “best effort” service. Experiences that are imperfect in following areas are ineligible for compensation:

GOALIES – Although StinkySocks Hockey cannot guarantee two goalies for any game, we do everything in our power to ensure that there are two goalies scheduled. As a result of our goalie backfilling process, it is rare that there is a game that goes forward without two scheduled goalies. However, on occasion, we may not be able to place two goalies, there may be a scheduled goalie who does not appear (no call/no show), or a goalie who calls out too late for another goalie to be placed.

LEVELING – We have an approach that ideally keeps leveling where it should be. That starts with the honestly of players, is monitored by our games staff, and is follow up upon by the office, in the case of a level violation.

MINIMUM NUMBER OF PLAYERS – In order to establish clear expectations we have specific minimum thresholds for how many players are needed for a game to proceed (see below, under “Cancellations or Changes by StinkySocks Hockey”). The numbers that we use in that determination are based on the information that we have regarding who has registered for a season pass or single game and not called out. However, it’s important to note that the actual amount of players may be different than those scheduled if there is/are players who have not called out as required if they do not intend to appear/play.

MAXIMUM NUMBER OF PLAYERS – We make every effort to ensure that no more than (20) skaters and (2) goalies are booked for a No Commitment Hockey game.

SERVICE GUARANTEES

GAME TIME – We guarantee that the scheduled ice block will be available for your No Commitment Hockey game or skills clinic at or about the time scheduled. In the case that the facility is running behind, start times may be delayed. In the case that a game is delayed more than 30 minutes or where a game is cannot be played (onsite cancelation), compensation in the form of a $10 promotional offer that can be used within 30 days towards another available No Commitment Hockey game or skills clinic. This guarantee does not apply to any event that has been canceled in advance or if there is a circumstance beyond our control that prevents ice availability or safe operation of a game at the facility.

REFEREE – We have a referee scheduled for every No Commitment Hockey Game. In the case that the scheduled referee does not appear, compensation in the form of a $10 promotional offer will be issued to be used towards another available No Commitment Hockey game within 30 days.

CANCELLATIONS OR CHANGES BY THE PLAYER

All No Commitment Hockey game and skills clinic purchases are non-refundable but cancellations more than 6 hours prior to event time are entitled to benefits. Cancellations cannot be reversed.

A promotional gift certificate in the amount of the full value of a canceled event is issued as a benefit when a callout for that game is received more than 6 hours before game time. Promotional gift certificates can be used for any purchase on our website within one month of the original game. Cancellations of any future games booked with promotional gift certificates that are entitled to cancellation benefits will be credited to this same code, with the expiration remaining the same. There is a limit of one promotional gift certificate per transaction.

TIME CHANGES

In the case of a schedule cancelation players will be notified at the email address on the original booking. Players will automatically be confirmed at the new game time if the time change is 60 minutes or less. In the case of a time change greater than 60 minutes, players may choose at the time of notification to receive a refund to the original form or payment or to be confirmed at the new game time being offered.

CANCELLATIONS BY STINKYSOCKS HOCKEY

In rare cases, it is required for StinkySocks Hockey to cancel a scheduled event. In the case of a cancelation, we will make every attempt to contact players. To facilitate that, it is important to have current contact information on your game order. Players are notified by text message, phone, and/or email. If you would like to be notified by text message (usually the quickest way to get out the message), please be sure that the primary phone number on your order is a number capable of receiving text messages.

For any game canceled by StinkySocks Hockey, a gift certificate code in the amount of the value of the game will be issued. This gift certificate does not expire.

MINIMUM THRESHOLD CANCELATIONS - There must be at least 8 skaters and 2 goalies OR 10 skaters and 1 goalie scheduled for a No Commitment Hockey game in order for a game to proceed. WEATHER-RELATED CANCELATIONS - Some games may be canceled in the event of weather. All weather-related decisions are deferred host facility as the entity in the best position to make a responsible decision based on the conditions in their area. Facilities may also deem it necessary to cancel a game if they are unable to provide a safe or otherwise usable playing surface.

By registering for a StinkySocks Hockey Season Pass, you are purchasing the non-transferable right to participate in each No Commitment Hockey game that is stated to be a part of that season pass and is on the schedule of the season pass, provided that you meet the qualifications for eligibility. Since your attendance directly affects the experience of other players, you agree to give advance notice to the league in accordance with our attendance policy in the event that you cannot attend a game that is a part of your season pass.

CANCELLATION OF SEASON PASS REGISTRATIONS

The purchase of a season pass can be canceled at any time up until 2 weeks prior to the date that the first game is scheduled for a full refund to the original form of payment. Thereafter, season passes are non-refundable for any reason, including but not limited to injury or relocation.

INJURY BENEFIT – If you become injured at any point when two or more games remain in your season pass, you may cancel your season pass and receive a gift certificate in the amount of 100% of the prorated value of the remaining games less the remaining payment plan balance (if applicable). A doctor’s note stating the nature of your injury and a recommendation that you do not play hockey must be provided. This is a regular gift certificate that does not have an expiration. Players who need to call out for a shorter timeframe can do so with individual callout game benefits. If selecting individual game benefits, the deadline of each promotional gift certificate will be reset at the time or return to be the same length of time you were injured (e.g. they will be valid for 6 weeks from your return if you were injured for 6 weeks) or one month, whichever is greatest.

MILITARY DEPLOYMENT BENEFIT – If you are an active military member and are deployed outside of the area during your season, you may cancel your season pass and receive a gift certificate in the full amount of the value of the remaining games when providing signed deployment orders. This is a regular gift certificate that does not have an expiration.

SWITCHING TO ANOTHER SEASON PASS

A player can, for any reason, switch to another season pass that is operating concurrently and has availability at the time of the request. The prorated credit of the season that you are transferring from will be applied to the prorated cost of the season that you are transferring to, with any credit balance being issued as a StinkySocks Hockey gift certificate code.

INDIVIDUAL GAME CANCELLATIONS

Season pass holders can receive benefits when canceling individual games, for up to 50% of the total number of games in their season pass (e.g. 8. games in a 16 game season pass). Benefits vary depending on the advance notice given for the callout, with a minimum notice of 3 hours required. Individual game cancellations within 3 hours of game time forfeit the value of the game. Game cancellations cannot be reversed once requested.

When calling out 6 or more hours prior to game time, a promotional gift certificate in the amount of the prorated cost of the season pass is issued as a benefit. Promotional gift certificates can be used for any purchase on our website within one month of the original game. Cancellations of any future games booked with promotional gift certificates that are entitled to cancellation benefits will be credited to this same code, with the expiration remaining the same. Please note that this means that a cancellation made after the expiration will result in forfeiture of the funds that are issued as a part of this benefit. Promotional gift certificates cannot be used to purchase regular gift certificates and cannot be combined. There is a limit of one promotional gift certificate per transaction.

When calling out 3 or more hours prior to game time, players may transfer into any Hot List game at no cost or apply a $10 credit towards any other game. The chosen game must be available at the time the game callout is processed and must be selected at the time of callout.

GAME TIME CHANGES

All changes will be noted and highlighted on the season schedule. In the event of a schedule change within seven days of the game, players will also be notified at the email address on their original season pass registration. Players will automatically be confirmed at the new game time if the time change within the stated game start day/time range indicated on the season pass registration page. In the case of a time change being outside of that range, players will be offered at the time of notification the option to receive a refund to the original form of payment if they do not wish to be confirmed at the new game time being offered.

GAME CANCELLATIONS BY STINKYSOCKS HOCKEY

In rare cases, it is required for StinkySocks Hockey to cancel a scheduled game. In the event of a cancelation, we will make every attempt to contact players. To facilitate that, it is important to have current contact information on your original season pass order. Players are notified by text message, phone, and/or email. If you would like to be notified by text message (usually the quickest way to get out the message), please be sure that your primary phone number on your order is a number capable of receiving text messages.

For any game canceled by StinkySocks players in a member’s season pass, the member may choose to switch to any No Commitment Hockey game that’s available at that time, be issued a gift code to be used in the future, or receive a refund to the original form of payment.

MINIMUM THRESHOLD CANCELLATIONS - There must be at least 8 skaters and 2 goalies OR 10 skaters and 1 goalie scheduled for a No Commitment Hockey in order for a game to proceed. If that threshold is not met, StinkySocks Hockey will cancel a game. Please note that the actual amount of skaters/goalies may be different than those scheduled if there is/are no call/no show(s).

WEATHER-RELATED CANCELLATIONS - Some games may be canceled in the event of weather. PARTICIPATION ELIGIBILITY

By registering for a BYOT League, you are purchasing eligibility to participate in each of the series of games that are scheduled for the team on whose roster you are registering, provided that you meet the qualifications for eligibility. You agree to be bound by the rules and policies of the StinkySocks Hockey. It is possible for your team to have more players eligible to play than are allowed to play in any one game. The captain for the team that you have registered for will bear the sole responsibility of determining which eligible players will play on a game to game basis.

CANCELATION OF LEAGUE REGISTRATIONS

BYOT League registrations are a commitment and cannot be canceled under any circumstance. All deposits and payments are final. Payment plans are offered as a convenience and do not exempt the player from their obligation to pay their share of the team payment in full under any condition.

SERVICE GUARANTEES

GAME TIME – We guarantee that the scheduled ice block will be available for your BYOT game at or about the time scheduled. In the case that the facility is running behind, game start times may be delayed. In the case that a game is delayed more than 30 minutes or where a game is cannot be played (onsite cancelation), a $50 team account credit will be issued. Team account credits for service guarantees carry forward to the season immediately following but are not refundable. This guarantee does not apply to any game that has been canceled in advance or if there is a circumstance beyond our control that prevents ice availability or safe operation of a game at the facility.

BYOT GAME STAFF - We make every effort to have two referees and a scorekeeper scheduled for every BYOT Game but in some cases that won't be possible due to staffing shortages. In the case that both referees do not appear, the game will not be played/counted and will always be rescheduled. If a game staff member fails to appear and your team feels that it has affected the quality of your experience, you may claim a goodwill credit for that game to be applied to the season immediately following: $50 for a missing referee with or without a scorekeeper, or $25 for a missing scorekeeper. Teams wishing to claim a credit must submit a claim request with a list of the game or games that were affected within 30 days of the end of the season that was affected.

MINI-BYOT GAME STAFF -We make every effort to have an off-ice official scheduled for every Mini-BYOT Game. In the case that the off-ice official does not appear, a $25 team account credit will be issued to the current season's account.

PAYMENTS

BYOT Leagues are priced PER TEAM, with the total cost of the season divided up amongst all of the players on the team. The individual player cost is determined by the final number or paying players on the team at the beginning of the season. To register for a team, each player must place a non-refundable $100 deposit and select whether the season balance should be paid in full at the start of the season or spread over a payment plan, if made available for the particular season. By registering for a BYOT league, players authorize StinkySocks Hockey to charge the card used for their deposit for the balance of their individual player cost, plus and applicable late fees, if the final payment option is not selected by the player. If a payment plan is elected, players authorize the charges to be made on the schedule offered, including any related payment plan fees or team cost adjustments.

Since the team’s payment is a shared responsibility, if any player’s payment cannot be collected within 21 days then that amount due will be assigned to the remaining players on the team, jointly and severally. Payments received from players added after the team cost is split that then result in a positive balance for the team, less any outstanding player payments, are credited after the conclusion of the season.

By registering for a BYOT team, you acknowledge responsibility for any outstanding balance that exists as a result of declined charge(s) or non-payment. Failure to make a final payment or elect a payment plan within 10 days of notice, or satisfy any outstanding balance, will result in a $20 late fee and, at the discretion of StinkySocks Hockey, may result in removal from eligibility from all StinkySocks Hockey games and events until payment is made. Players who are removed from eligibility due to an overdue balance are not entitled to any compensation for games that are missed while ineligible. In the event that StinkySocks Hockey must resort to third party collections, or legal action, to collect on your account, you agree to be responsible for any necessary costs incurred in the process.

RIGHT AND AGREEMENT TO PARTICIPATE

By registering for a StinkySocks Hockey Draft League, you are purchasing the non-transferable right to participate in the games that are stated to be a part of that league, and are on the schedule provided for the team on which you are "drafted" (assigned to) at the beginning of the season, provided that you meet the qualifications for eligibility. You agree to be bound by these terms and conditions and the rules and policies of the league. At any time during the season you, as an individual player, may be moved to any team in the same draft league for any reason that the league determines is necessary, including team parity within that league.

BEST EFFORT SERVICE PROMISES

We want every game to be perfect and our promise to you is that we’ll make every effort for that to happen. However, there are many variables involved in producing a game, some of which may be out of our direct control at times. As such, our Draft League games are offered as a “best effort” service. Experiences that are imperfect in the following areas are ineligible for compensation:

GOALIES – Although StinkySocks Hockey cannot guarantee two goalies for any game, we do everything in our power to ensure that there are two goalies scheduled. As a result of our goalie backfilling process, it is rare that there is a game that goes forward without two scheduled goalies. However, on occasion, we may not be able to replace a goalie who has called out or there may be a scheduled goalie who does not appear (no call/no show).

LEVELING – We make every effort to ensure that teams in our draft leagues are even and will make changes throughout the season to that end.

SERVICE GUARANTEES

GAME TIME – We guarantee that the scheduled ice block will be available for your Standard Game at or about the time scheduled. In the case that the facility is running behind, game start times may be delayed. In the case that a game is delayed more than 30 minutes or where a game is cannot be played (onsite cancelation), compensation in the form of a $10 promotional offer that can be used within 30 days towards an available Standard Game booked through No Commitment Hockey. This guarantee does not apply to any game that has been canceled in advance or if there is a circumstance beyond our control that prevents ice availability or safe operation of a game at the facility.

REFEREE (NOT VALID FROM 9/2021 UNTIL FURTHER NOTICE DUE TO KNOW STAFFING SHORTAGES) - We have two referees scheduled for every draft league game. In the case that the scheduled referee does not appear, compensation in the form of a $5 promotional offer will be issued before the season end, to be used within 30 days of issue towards an available Standard Game booked through No Commitment Hockey.

CANCELLATION OF DRAFT LEAGUE REGISTRATIONS

The purchase of a draft league can be canceled at any time up until 2 weeks prior to the date that the first game is scheduled for a full refund to the original form of payment. Draft league registrations are not otherwise refundable in part or whole for any reason, including injury or relocation.

MILITARY DEPLOYMENT BENEFIT – If you are an active military member and are deployed outside of the area during your season, you may cancel your season pass and receive a gift certificate in the full amount of the value of the remaining games when providing signed deployment orders. This is a regular gift certificate that does not have an expiration.

GAME TIME CHANGES

Your schedule may change at any time but will always be within the context of the days and times that are expected. In the event of a schedule change within seven days of the game, players will be notified at the email address on their original registration.

GAME CANCELLATIONS BY STINKYSOCKS HOCKEY

In rare cases, it is required for StinkySocks Hockey to cancel a scheduled game. In the event of a cancelation, we will make every attempt to contact players. To facilitate that, it is important to have current contact information on your original season pass order. Players are notified by text message, phone, and/or email. If you would like to be notified by text message (usually the quickest way to get out the message), please be sure that your primary phone number on your order is a number capable of receiving text messages.

Canceled games will be rescheduled and noted on your schedule.

WEATHER-RELATED CANCELLATIONS - Some games may be canceled in the event of weather. All weather-related decisions are deferred host facility as the entity in the best position to make a responsible decision based on the conditions in their area. Facilities may also deem it necessary to cancel a game if they are unable to provide a safe or otherwise usable playing surface.

RIGHT AND AGREEMENT TO PARTICIPATE

By registering for a tournament or other event that is not specifically addressed elsewhere in the Terms and Conditions of Sale, you are purchasing the non-transferable, right to participate in the event, per the terms outlined on the event page at the time of purchase. You agree to be bound by the rules and policies of the StinkySocks Hockey. For tournaments, you agree to play as scheduled, as your participation directly effects the experience of other participants.

CANCELATION

Purchases, including deposits, of any event, including but not limited to tournaments and trips, are non-refundable, unless otherwise stated at the time of purchase. Please refer to the specific terms of the event that you are purchasing for any exceptions.

No Commitment Hockey

RIGHT AND AGREEMENT TO PARTICIPATE

By purchasing a game or skills clinic through No Commitment Hockey (“NCH”), you are purchasing the non-transferable right to participate in that event, provided that you meet the qualifications for eligibility. You agree to be bound by these terms and conditions and the rules and policies of the league. Since your attendance at a No Commitment Hockey games directly affects the experience of other players, you agree to give notice to the league in accordance with our attendance policy in the case that you cannot attend the game that you have purchased.

However, there are many variables involved in producing a game, some of which may be out of our direct control at times. The numbers that we use in that determination are based on the information that we have regarding who has registered for a season pass or single game and not called out. However, it’s important to note that the actual amount of players may be different than those scheduled if there is/are players who have not called out as required if they do not intend to appear/play.

MAXIMUM NUMBER OF PLAYERS – We make every effort to ensure that no more than (20) skaters and (2) goalies are booked for a No Commitment Hockey game.

SERVICE GUARANTEES

All No Commitment Hockey game and skills clinic purchases are non-refundable but cancellations more than 6 hours prior to event time are entitled to benefits. Cancellations cannot be reversed.

A promotional gift certificate in the amount of the full value of a canceled event is issued as a benefit when a callout for that game is received more than 6 hours before game time. Promotional gift certificates can be used for any purchase on our website within one month of the original game. Cancellations of any future games booked with promotional gift certificates that are entitled to cancellation benefits will be credited to this same code, with the expiration remaining the same. There is a limit of one promotional gift certificate per transaction.

TIME CHANGES

In the case of a schedule cancelation players will be notified at the email address on the original booking. Players will automatically be confirmed at the new game time if the time change is 60 minutes or less. In the case of a time change greater than 60 minutes, players may choose at the time of notification to receive a refund to the original form or payment or to be confirmed at the new game time being offered.

CANCELLATIONS BY STINKYSOCKS HOCKEY

Since your attendance directly affects the experience of other players, you agree to give advance notice to the league in accordance with our attendance policy in the event that you cannot attend a game that is a part of your season pass.

INJURY BENEFIT – If you become injured at any point when two or more games remain in your season pass, you may cancel your season pass and receive a gift certificate in the amount of 100% of the prorated value of the remaining games less the remaining payment plan balance (if applicable). A doctor’s note stating the nature of your injury and a recommendation that you do not play hockey must be provided. This is a regular gift certificate that does not have an expiration. Players who need to call out for a shorter timeframe can do so with individual callout game benefits. If selecting individual game benefits, the deadline of each promotional gift certificate will be reset at the time or return to be the same length of time you were injured (e.g. they will be valid for 6 weeks from your return if you were injured for 6 weeks) or one month, whichever is greatest.

SWITCHING TO ANOTHER SEASON PASS

A player can, for any reason, switch to another season pass that is operating concurrently and has availability at the time of the request. The prorated credit of the season that you are transferring from will be applied to the prorated cost of the season that you are transferring to, with any credit balance being issued as a StinkySocks Hockey gift certificate code.

INDIVIDUAL GAME CANCELLATIONS

Season pass holders can receive benefits when canceling individual games, for up to 50% of the total number of games in their season pass (e.g. 8. games in a 16 game season pass). Benefits vary depending on the advance notice given for the callout, with a minimum notice of 3 hours required. Individual game cancellations within 3 hours of game time forfeit the value of the game. Game cancellations cannot be reversed once requested.

When calling out 6 or more hours prior to game time, a promotional gift certificate in the amount of the prorated cost of the season pass is issued as a benefit. Promotional gift certificates can be used for any purchase on our website within one month of the original game. Cancellations of any future games booked with promotional gift certificates that are entitled to cancellation benefits will be credited to this same code, with the expiration remaining the same. Please note that this means that a cancellation made after the expiration will result in forfeiture of the funds that are issued as a part of this benefit. Promotional gift certificates cannot be used to purchase regular gift certificates and cannot be combined. There is a limit of one promotional gift certificate per transaction.

When calling out 3 or more hours prior to game time, players may transfer into any Hot List game at no cost or apply a $10 credit towards any other game. The chosen game must be available at the time the game callout is processed and must be selected at the time of callout.

In the event of a schedule change within seven days of the game, players will also be notified at the email address on their original season pass registration. Players will automatically be confirmed at the new game time if the time change within the stated game start day/time range indicated on the season pass registration page. In the case of a time change being outside of that range, players will be offered at the time of notification the option to receive a refund to the original form of payment if they do not wish to be confirmed at the new game time being offered.

BYOT

PARTICIPATION ELIGIBILITY

By registering for a BYOT League, you are purchasing eligibility to participate in each of the series of games that are scheduled for the team on whose roster you are registering, provided that you meet the qualifications for eligibility. You agree to be bound by the rules and policies of the StinkySocks Hockey. It is possible for your team to have more players eligible to play than are allowed to play in any one game. The captain for the team that you have registered for will bear the sole responsibility of determining which eligible players will play on a game to game basis.

CANCELATION OF LEAGUE REGISTRATIONS

BYOT League registrations are a commitment and cannot be canceled under any circumstance. All deposits and payments are final. Payment plans are offered as a convenience and do not exempt the player from their obligation to pay their share of the team payment in full under any condition.

SERVICE GUARANTEES

GAME TIME – We guarantee that the scheduled ice block will be available for your BYOT game at or about the time scheduled. In the case that the facility is running behind, game start times may be delayed. In the case that a game is delayed more than 30 minutes or where a game is cannot be played (onsite cancelation), a $50 team account credit will be issued. Team account credits for service guarantees carry forward to the season immediately following but are not refundable. This guarantee does not apply to any game that has been canceled in advance or if there is a circumstance beyond our control that prevents ice availability or safe operation of a game at the facility.

BYOT GAME STAFF - We make every effort to have two referees and a scorekeeper scheduled for every BYOT Game but in some cases that won't be possible due to staffing shortages. In the case that both referees do not appear, the game will not be played/counted and will always be rescheduled. If a game staff member fails to appear and your team feels that it has affected the quality of your experience, you may claim a goodwill credit for that game to be applied to the season immediately following: $50 for a missing referee with or without a scorekeeper, or $25 for a missing scorekeeper. Teams wishing to claim a credit must submit a claim request with a list of the game or games that were affected within 30 days of the end of the season that was affected.

MINI-BYOT GAME STAFF -We make every effort to have an off-ice official scheduled for every Mini-BYOT Game. In the case that the off-ice official does not appear, a $25 team account credit will be issued to the current season's account.

BYOT Leagues are priced PER TEAM, with the total cost of the season divided up amongst all of the players on the team. CANCELATION

Purchases, including deposits, of any event, including but not limited to tournaments and trips, are non-refundable, unless otherwise stated at the time of purchase. Please refer to the specific terms of the event that you are purchasing for any exceptions.
